In the state of Florida, the first requirement to obtain a Final Judgment of Dissolution of Marriage is that both parties are convinced the marriage is broken beyond repair (irretrievably broken). (Click here for statutory grounds). Specifically, a divorce can be uncontested whether the parties have children or not, as long as they are both in agreement as to the division of assets/debts and to the child-related issues.
If you have children born to the marriage, may (or may not) have assets and/or debts in common, but have already agreed as to how those assets and/or debts are going to be distributed, and have solved all child-related issues, such as timesharing schedule, child support and parental responsibility, you may qualify for an uncontested Dissolution of Marriage with Minor Children.
