In the state of Florida, a Final Judgment of Dissolution of Marriage can be granted as long as both parties are convinced the marriage is broken beyond repair (irretrievably broken). Specifically, a simplified divorce takes place when the parties have no children born to the marriage, have no assets or liabilities in common, and none is seeking any relief, such as alimony.

In the state of Florida, the first requirement to obtain a Final Judgment of Dissolution of Marriage is that both parties are convinced the marriage is broken beyond repair (irretrievably broken). Specifically, a divorce can be uncontested whether the parties have children or not, as long as they are both in agreement as to the division of assets/debts and to the child-related issues.

If you have children born to the marriage, may (or may not) have assets and/or debts in common, but have already agreed as to how those assets and/or debts are going to be distributed, and have solved all child-related issues, such as timesharing schedule, child support and parental responsibility, you may qualify for an uncontested Dissolution of Marriage with Minor Children.

A paternity action takes place when there are children common to both parties that have never been married. In Florida, paternity needs to be established in court. Child support can be handled through the Department of Child Support Enforcement. However, other child-related issues such as timesharing and parental responsibility can only be tried in family court.

You can submit your request to the court as a separate procedure as long as you are not currently litigating either a divorce or an adoption case. Whether your name change is for yourself or your minor children, you are required to have your fingerprints taken for purposes of a background check.

Uncontested Adoption by Stepparent

Sometimes you have a child (or children) born to a former partner that is no longer interested in maintaining his/her status as a parent. If you are married and would like your current spouse to officially adopt your child(ren), and as long as both biological parents are in agreement to terminate his/her parental rights, you could file for adoption with the clerk of courts.
